Program Topic:  HR Nightmares Before Christmas (and Thanksgiving, Hanukkah, Kwanzaa, Ramadan and Every Other Holiday)

Program Description:
From Christmas Vacation to Bad Santa, don’t let the Grinch steal Christmas. Instead conquer the legal issues involved with the holidays, including:

   1.  Religious displays and accommodations:  Can I say “Merry Christmas?” “Happy Hanukah?”  Can we have a tree? A Menorah?  Do I have to allow an employee to take off for religious observances?
   2.  Legal risks of holiday parties: from alcohol to mistletoe;
   3.  Inclement weather;
   4.  Holiday and vacation pay and scheduling;
   5.  Kids in the workplace (HIPAA, Confidentiality, Child labor)
   6.  Seasonal Affective Disorder;
   7.  Potluck Potpourri:  If we require employees to bring food, is that work? If 10 people get sick because we left food out all morning, is that compensable or a negligence suit?  Pot laced brownies
   8.  We are all going to volunteer at the local shelter on Saturday.  Is this work?

Speakers from Friday, Eldredge and Clark Law Firm: 

Daniel L. Herrington is a partner in the Labor and Employment Relations Practice Group focused on representing employers in all areas of labor and employment law, including ADA, FMLA, Wage and Hour, Title VII, OSHA and NLRA. He proactively works with his management clients to help ensure their employment decisions can withstand legal scrutiny. Dan has successfully defended those decisions before state and federal agencies and courts, including the EEOC, OSHA, NLRB, DOL, Arkansas Supreme Court and U.S. Court of Appeals for Eighth Circuit. He also has extensive experience in litigating covenant not to compete and trade secret cases.

Twice voted as one of the top labor and employment attorneys in Arkansas by the readers of Arkansas Business, Dan has also been recognized nationally for his work in labor and employment since 2010 in Chambers USA: America’s Leading Lawyers for Business and since 2011 by Mid-South Super Lawyers and The Best Lawyers in America. In addition, he was named by Best Lawyers as Lawyer of the Year 2018 for his work in litigation - labor and employment.

Michael S. Moore is a partner in the firm’s Labor and Employment Practice Group with an emphasis on employment discrimination defense. He specializes in litigation of discrimination cases, wage-hour matters, sexual harassment, wrongful discharge, FMLA and employee and supervisor training. He is also a frequent speaker on a variety of employment law topics.  Mike has extensive experience before the EEOC and the Wage-Hour Division of the United States Department of Labor, as well as litigation experience in both federal and state courts. He is a member of the Pulaski County, Arkansas and American Bar Associations.

Mike is also deeply involved in the business community. He is a board member of the Arkansas State Chamber of Commerce and is the chair of its Unemployment Insurance Committee. He is also a member of on the Greater Little Rock Chamber of Commerce Leadership Greater Little Rock Advisory Board and was co-chair and chair of the XXV and XXI of that program as well as a past graduate. He has also been on a number of non-profit boards in central Arkansas including the American Heart Association, Downtown Rotary Club and Wolfe Street Foundation. Mike is named Lawyer of the Year 2018 by Best Lawyers for his work in employment law - management. He is top-ranked by Chambers USA: America’s Leading Lawyers for Business, a publication respected for the caliber of its research on listed lawyers. 

H. Wayne Young is a partner with the firm and a member of the Labor and Employment Law Practice Group. He was named the 2017 Russell Gunter Legislative Advocacy Award Recipient by the Arkansas SHRM. The award recognizes outstanding contributions of time and effort in local, state or federal legislative advocacy on behalf of the Human Resources profession. 

He has also been named in The Best Lawyers in America publication annually since 2015, and has been listed as a Rising Star in the Mid-South by Super Lawyers magazine annually since 2013. He is on the Board of Directors of Women and Children First and he is President-Elect of the Little Rock Downtown Kiwanis Club. Wayne currently serves as General Counsel to the Arkansas State Council of the Society of Human Resource Management.
